REZUMAT

În permanenta noastră șlefuire profesională, ca muzicieni ai secolului XXI, devine aproape imposibil să nu fi auzit despre Ableton, Sibelius, Cubase, Logic, Studio one etc., programe muzicale pentru calculator pe care unii dintre noi le stăpânesc chiar foarte bine. În acest context, devine vital – chiar dacă suntem doar simpli utilizatori, legitimi sau nelegitimi – să conștientizăm exact întinderea și trăsăturile protecției juridice ce le sunt oferite acestor programe în sistemul juridic român (implicit comunitar), drepturile autorilor lor în ramura dreptului de proprietate intelectuală, dar mai ales riscurile la care ne expunem în momentul în care ignorăm sau abuzăm de utilizarea lor nelegitimă. Deopotrivă, încercăm să sintetizăm și drepturile ce izvorăsc din utilizarea lor legitimă, cât și indicarea adnotată a textelor legale ce ne trimit la „Protecția și regimul juridic al programelor – inclusiv cele muzicale – pentru calculator în sistemul de drept roman“.

ABSTRACT

In our permanent professional improvement, as 21st century musicians, it is almost impossible not to have heard of Ableton, Sibelius, Cubase, Logic, Studio One, etc., computer music programs that some of us do master actually very well. In this context, it becomes vital - even if we are just simple users, legitimate or illegitimate - to be aware of the extent and the features of the legal protection offered to these programs in the Romanian legal system (implicitly in the EC legal system), the rights of their authors in the field of intellectual property rights, but above all, of the risks we expose ourselves to, when ignoring or using them illegitimately. We try to synthesize the rights stemming from their legitimate use, as well as the annotated indication of the legal texts that send us to “The protection and legal status of computer programs - including the musical ones - in the Romanian law system.”
